And if you have to get hit, a van loaded with ins is the way to be hit
Dealer should do you well, they'll nit pick every nut n bolt so you'll get a big repair bill to the insurance.
Don't sign off on medical if they try to get you to do so, my buddy was hit a year ago, from the side when a gal pulled over on him, not a ton of damage to the bike but his knee was sore, it's been a year of therapy to get it right, he still has problems sometimes when moving the bike back into parking etc. Then again he's a short guy LOL
Get an attorney to review it, you have a lot of recoverable rights when you're on a bike vs. just paint, chrome and labor. |

You'd think passing a slow moving cager wouldn't be too dangerous (only going 25 mph)..wrong. |

| I just got back from the dealership. They're going to do a great job. We were looking at dashes and emblems and paint and footpegs and all kinds of new stuff. We're going to see if the new Cat's Eye dash from the Cross bones will work, and I've picked out emblems from a 61-62 Pan. I know the dash and the emblems are not consistent, but it'll be cool. Thunder Mountain has a custom paint shop down in Denver, so I'll probably go down there to choose my paint. I'm thinking a black basecoat with red metal flake. They have a custom on the floor that is similar, but it's an orange flake. The front of the tank has less metal flake, so it looks darker up front and has more color going back.
The worst part is that it could be as long as two months or longer. That's the whole f'ing summer, and my vacation plans are shot. I have a call into a lawyer to see if I can make them rent me a bike since I make money that way.
I see some serious pain and suffering, especially for anyone around me. |

I was going to ask you about hog nat membership , do you have to join a local chapter? or can you just use there goodies ie towing discount at stealer ship | Not trying to but in cowboy but u do not have to belong to local chapter to be a national member. I'm national member only, my membership runs out end of this month and i'm not rejoining, don't think its worth it. Waited over 3 hrs. while they were tring to find tow truck, found one on my own (they never did) had it hauled back to knoxville, over 200 miles, (HOG PAYS NEAREST DEALER) turned it in on my car/truck insurance and they paid full amount.

| Actually the HOG part is working in my favor. I called up and asked how to get my towing reimbursement. She asked if I'd called their number, and I told her I was in the ambulance and someone else called them for me. They're going to reimburse $100. On the other hand, I have towing included in my motorcycle insurance policy. I'm still not sure what I'm going to do there.
Well I was in tears yesterday (first time since the wreck) when I was told they were only going to pay $5,100 towards repair (the estimate was $7,200 thanks to the custom paint job) or total it. The guy said, "salvage yard" and I lost it. My baby is NOT going to a junk yard. It all worked out in the end. Besides, regardless of what my insurance company will pay, her insurance company will have to make everything right. Plus some. I was hoping that my insurance company would get the repairs done quickly, and the settlement with the other insurance company could be worked out as needed. I think it might still work out like that.
My issue now is lawyer or no lawyer. I have two calls in and none returned. I don't want to continue to wait to make my statement and get the ball rolling. Some people are telling me to wait until I have a lawyer to make a statement, and others are saying to wait until things aren't going the way I want them to before I get a lawyer. Seeing as how it's so cut and dried, I'm not sure how waiting for a lawyer is going to benefit me. I was stopped for traffic. I got hit. There just isn't that much more to it. |

| You need to get an attorney if you have problems and if you think you'll have more possible medical expenses in the future such as a friend of mine needing therapy on his leg possibly for life.

There are some interesting things to read about on the site
It's not wrong to talk with an attorney before proceeding, find out the costs, the advantages, disadvantages, a good attorney will advise you properly not just file a suit.
Information is key.
BTW they tried to total the bike my buddy wrecked in NC, he had all the custom part receipts pictures custom paint etc It took about 90 days but he ended up with the bike, no salvage title and the cash.
Take your time, also you may have the ability to claim against your own uninsured underinsured if the other guys insurance doesn't pick up the full tab,
Sounds to me like you need to get some solid legal advice.
Hang in there, many a custom bike has come from insurance settlements on accidents. |

| Abby, I think you should definitely talk to an attorney. You could very well get a cash settlement beyond medical and damage to your bike. For your anguish and not being able to ride for a bit, plus time spent hassling with all this, I think it just might be worth something. I'm not a sue-happy person, but a decent lawyer could get a fairly quick settlement both sides could be happy with. It's worth at least a meeting with a lawyer. |

| Man that really sucks. But anytime you go down, and can get back on, you have been blessed. Glad to hear you'll be ok. The boys are probably right about some legal council on this one, even if it drags it out a little longer.

| I called the lawyer again this afternoon and hope to hear back tomorrow. I have this small notebook I've been carrying around and noting time spent at the doc's office, mileage, and if I have to work later to make up time lost well as any sick time I've had to take. I went out with friends tonight and we kept pointing out all the things that were such a pain in the ass, like constantly sticking my fingers in the scoop of sour cream because of the stupid cast. I'll be writing everything in the book. We're calling it, "Abby's Little Book of Pain and Suffering".
I'm laughing now, but when I run out of Vicodan, we'll see how funny I find it all. Every time I see a motorcycle I feel like my freedom has been taken from me. I know I'm fortunate that it wasn't any worse, but I feel so violated. |

| The other insurance company sent someone out and they are paying exactly what we asked for! Should have a check next week. I guess they saw that it wasn't just a plain old softail.  |

| The other insurance company has already said they'd pay for pain and suffering; now to see how much. I used to think that was a real scam until it happened to me. Seriously, so much has become so screwed up because of it.
I just moved here and had planned on joining a HOG chapter after the rally and getting out and meeting a lot of people. I also teach for ABATE, which is really active in Colorado. Big picnic this weekend where I could meet a lot of people. I refuse to drive my car there. One of the instructors offered to let me take his old Shovelhead, but I can't clutch yet. So, there goes the social life.
New job: it's always good when you start a new job to be taking tons of time off for doctor's appointments. It's great for the career. It's even better when you really can't take the time, so you're working extra hours to make up for the doc appointments, even though you feel like you've been hit by a truck.
Live to Ride vs Live to Drive around in a Toyota Corolla - yeah, right. I've canceled my vacation.
Not to mention all the money spent on co-pays (being tracked very carefully) and the new Wii with extra games because what the hell else am I going to do over the long weekend while everyone's out riding and having a great time.
I understand pain and suffering now. |

| well abby, i know it is not much consolation, but i may not be riding this weekend either.....takin the ol' chaindrive cams out of my bike and putting in gear drive.............should make the bike last longer, but may not be riding this weekend either...................have a great safe fouth ...........  |

Hate to hear about this dude, Glad yer not hurt any worst than what yer saying. Seems like everytime I turn around somebody on a scooter is getting nailed from behind on a scooter. Hate to hear about the damage to yer scooter dude.
I had been telling Chucktx about it in the past.
The OL and me was comin back home saturday with the runnin lights on from going out to eat we runnin about 75 and a car come out from the right hand side of the road crossing a 4 lane highway and run us out of our lane into the lane next to us as we tried to advoid him. I blew the horn and threw my arms in the air. Seemed like I was in his way. |
